Avoiding Fines and Headlines: Federal Post-Acute Enforcement Investigations, Cases, and Appeals

The session will review recent Health & Human Services post-acute enforcement actions. Program will emphasize Departmental Appeals Board cases and Administrative Law Judge decisions for survey and certification and a review of recent case law relating to long term care facilities. Recent cases have included Section 1557 compliance violations; failure to supervise office manager’s handling of resident funds; and inadequately addressing sexual interactions between cognitively impaired residents.
