Brandon Helms, Shareholder at Hall Render, joined Jackie Papish, Partner at Barnes & Thornburg LLP, on AHLA’s Speaking of Health Law podcast to discuss delays in Department of Justice (“DOJ”) investigations under the False Claims Act (“FCA”). The conversation explores why DOJ investigations can remain under seal for extended periods, the operational and financial impact these delays have on providers, how the Fifth Circuit’s 2023 decision in United States ex rel. Aldridge v. Corporate Management, Inc. highlighted concerns regarding excessive delays, and potential reforms to improve the system. Brandon also discusses his recent co-authored article in AHLA’s Health Law Connections magazine on this topic.
