On January 30, 2023, President Biden announced that the COVID-19 Public Health Emergency (“PHE”) declared by the Trump administration in 2020 would be ending on May 11, 2023. As a result, most of the health care flexibilities implemented by the federal government to address the pandemic under the Section 1135 blanket waivers will also expire on May 11, 2023.
