FTC Seeks to Make Non-Compete Clauses for Workers Illegal
On January 5, 2023, in a move that will likely have a monumental impact for many employers across the country, the Federal Trade Commission (“FTC”) issued a Notice of Proposed Rulemaking (the “Proposed Rule”) that seeks to make it illegal for employers to enter into non-compete clauses with workers. While the FTC has limited jurisdiction over non-profit organizations—meaning the Proposed Rule will have a limited impact on non-profit organizations—there has been bipartisan support in the past to remove this jurisdictional limitation. Also, for-profit joint-ventures of otherwise non-profit health systems would still be subject to the Rule. Additionally, the current FTC has recently taken an aggressive stance towards antitrust enforcement, so non-profit entities may not necessarily remain unscathed by the Proposed Rule.
