About David

Dave Stoltzfus is a health care antitrust attorney who advises hospitals, health systems, physicians and other providers on federal and state antitrust matters affecting transactions, investigations and business operations.

He represents clients in mergers and other civil antitrust matters before the Federal Trade Commission and the U.S. Department of Justice and counsels organizations on the application of antitrust laws to a broad range of strategic and operational activities. Dave brings practical insight into regulatory review processes and helps clients navigate complex competition issues in the health care industry.

Dave’s practice includes:

  • Counseling clients on antitrust considerations related to business arrangements and operational strategies;
  • Representing clients in antitrust merger reviews;
  • Representing clients in federal or state civil antitrust investigations; and
  • Responding to government and private-party requests for information in investigations and litigations.

Before joining Hall Render, Dave served for more than ten years as a Trial Attorney in the Healthcare and Consumer Products Section of the Department of Justice’s Antitrust Division, where he led investigations involving health care mergers and anticompetitive conduct and litigated antitrust matters in federal court. At the Antitrust Division, Dave led or held key roles in multiple significant enforcement matters related to health care and other industries. Dave was also responsible for overseeing the implementation of consent decrees and worked closely with court-appointed monitors and other outside parties to ensure compliance.

Significant Cases

Representative matters while at the Antitrust Division include:

  • United States v. Anheuser-Busch InBev SA/NV and SABMiller plc.  Secured divestiture of target’s entire United States business and conduct relief to resolve challenge to $107 billion beer merger, including the appointment of a monitor to oversee compliance with a 10-year consent decree.
  • United States v. Aetna, Inc. and Humana, Inc.  Successful challenge to the proposed merger of two large health insurance companies.
  • United States et al. v. Harvard Pilgrim Health Care, Inc. and Health Plan Holdings, Inc. Secured divestiture of New Hampshire commercial insurance business to resolve merger challenge.
  • United States et al. v. The Charlotte-Mecklenburg Hospital Authority.  Obtained consent decree resolving challenge to steering restrictions imposed by a hospital system.
  • United States v. Geisinger Health and Evangelical Community Hospital.  Obtained consent decree to resolve partial acquisition of a community hospital by a competing hospital system.
  • United States v. Aon plc and Willis Towers Watson plc. Challenge to a merger between two of the three largest insurance brokers, which was abandoned by defendants before trial.
  •  United States et al. v. UnitedHealth Group and Change Healthcare, Inc.  Challenge to acquisition of health care technology company by large insurance company.
  • United States et al. v. UnitedHealth Group Inc. and Amedisys Inc.  Secured largest divestiture by number of facilities of outpatient healthcare services to resolve merger challenge and obtained $1.1 million civil penalty.
